Contested versus uncontested divorce

Tennessee couples who decide to officially split have two potential directions that their divorce could take: contested and uncontested.

A contested divorce is a situation in which the parties involved are not in agreement on issues that are important to the outcome of the divorce. Such issues can include matters of property division, debt division, child support, visitation schedules, and alimony payments. In some cases, a contested divorce may even involve a couple disagreeing on whether or not to get a divorce in the first place, with one party wanting to split up and the other wanting to stay together.

On the other hand, an uncontested divorce is the different. In this scenario, both parties agree on all of the matters mentioned earlier and then some. This is why it’s so difficult for couples to achieve uncontested divorces. It requires mutual agreement in all aspects of a very sensitive situation.

However, uncontested divorce doesn’t need to be achieved alone. Many people who would prefer uncontested divorces can utilize tools that help them reach agreements more smoothly. For example, couples may turn to a divorce attorney or mediator. They act as a third party that helps referee arguments, ensuring that fair terms can be found in which both parties benefit and all matters are handled according to the law.
